These Terms of Service are provided by GYMENTA CODENCE LTD (“we”, “our”, “us”), the owner and developer of the Gymenta application (“Gymenta”, “app”, or “Service”).
By downloading or using the Gymenta app, these terms will automatically apply to you – please read them carefully before using the app.
1. Acceptance of Terms
By using the Gymenta app, you agree to these Terms of Service. If you disagree with any part of these terms, you must discontinue use of our app.
2. License to Use
Gymenta grants you a limited, non-exclusive, non-transferable license to use the app for your personal and professional fitness training needs in accordance with these Terms.
3. User Data
You are responsible for maintaining the confidentiality of any data you enter into the app. You retain full ownership of your client data and other information you input into the app. Please refer to our Privacy Policy for how we handle your personal information.
4. Restrictions
You agree not to:
• Copy, modify, distribute, sell, or lease any part of our app
• Reverse engineer or attempt to extract the source code
• Use the app for any illegal purpose or in violation of any local laws
• Interfere with or disrupt the app’s performance
• Collect or harvest information from the app
5. Intellectual Property
The app, including its content, features, and design, is owned by Gymenta and protected by copyright, trademark, and other intellectual property laws. Our branding may not be used without prior written consent.
6. Liability
To the maximum extent permitted by law, Gymenta shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, or goodwill, resulting from your use or inability to use the app.
7. Subscription Terms
Our app offers subscription-based services:
• Exploration Period: When you first encounter subscription prompts, you may explore premium features for a limited time (up to 12 hours) to evaluate the application before making a purchase decision.
• Trial Period: A 3-day free trial is available for new subscribers. After it expires, a subscription is required to continue using premium features.
• Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the billing period.
• Billing: Charges are made to your App Store account within 24 hours before renewal.
• Cancellation: Manage or cancel via your App Store account settings.
• Refunds: Unused trial time is forfeited upon subscription. Refunds are handled by Apple: support.apple.com/en-us/HT204084
• Price Changes: Subscription prices may change; any updates will apply to the next billing cycle and be communicated in advance.
• Feature Availability: We aim to keep all features available during your subscription but reserve the right to make adjustments for technical or legal reasons.
8. Disclaimer of Warranties
Gymenta is provided “as is” and “as available”. We make no warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose.
9. Changes to Terms
We may modify these terms at any time. Changes will be posted on this page. Continued use of the app after changes indicates your acceptance of the new terms.
10. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
